Terms of Service Agreement
This Terms of Service Agreement (the "Agreement") is entered into by and between Starter Plan ("Company") and the users ("Users") of the AI-Powered Business Plan Generator (the "Service"). By accessing or using the Service, Users agree to be bound by the terms and conditions of this Agreement.
1. Description of Service
The AI-Powered Business Plan Generator is an online platform that simplifies the process of creating detailed business plans and marketing strategies. The Service provides comprehensive guidance and support, addresses pain points of Users, and offers customizable and tailored approaches to business development. It utilizes AI technology, a database of questions and templates, and expertise in business planning and marketing strategy.
2. User Obligations
2.1 Eligibility
Users must be at least 18 years old and capable of entering into a legally binding agreement. By using the Service, Users represent and warrant that they meet these eligibility requirements.
2.2 Account Registration
Users may be required to create an account to access certain features of the Service. Users agree to provide accurate and complete information during the registration process, and to keep their account information updated. Users are solely responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.
2.3 Prohibited Activities
Users agree not to engage in any of the following prohibited activities:
- Violating any applicable laws or regulations
- Infringing upon the intellectual property rights of others
- Uploading or transmitting any viruses, malware, or other malicious code
- Interfering with the operation of the Service
- Engaging in any fraudulent or deceptive activities
3. Pricing and Payment
Users can access the Service by purchasing a single plan or a package of three plans. The pricing for each option is as follows:
- Package of 3 plans: $420 per user
- Package of 10 plans: $960 per user
Users agree to pay the specified fees for the selected option. Payment must be made in full and in advance. All fees are non-refundable.
4. Ownership of Ideas and Generated Materials
All ideas and materials generated by Users through the Service shall belong to the respective User. The Company acknowledges that Users retain all ownership rights to their ideas and materials. The Company shall not use, distribute, or transfer the ideas and materials provided by Users for profit or any other commercial purposes without the prior written consent of the User.
5. Intellectual Property
The Service, including all content, templates, and AI technology, is the property of the Company and is protected by intellectual property laws. Users are granted a limited, non-exclusive, non-transferable license to use the Service for their own business planning purposes. Users may not copy, modify, distribute, or create derivative works based on the Service without the prior written consent of the Company.
6. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of the Service. The Company's total liability, whether in contract, tort, or otherwise, shall not exceed the amount paid by the User for the Service.
7. Termination
The Company may suspend or terminate a User's access to the Service at any time, without prior notice or liability, for any reason whatsoever. Upon termination, Users will no longer have access to their account and any data or content associated with it may be permanently deleted.
8. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of Montenegro. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Montenegro.
9. Amendments
The Company reserves the right to modify or amend this Agreement at any time. Users will be notified of any changes and continued use of the Service after such notification constitutes acceptance of the modified Agreement.
10. Entire Agreement
This Agreement constitutes the entire agreement between the Company and Users regarding the Service and supersedes all prior agreements and understandings, whether written or oral.
By accessing or using the AI-Powered Business Plan Generator, Users acknowledge that they have read, understood, and agreed to be bound by this Terms of Service Agreement.
